Barney Estates & Auctioneers Auction Terms and Conditions
Our auctions will be live-streamed via our website with remote bidding by proxy, telephone or internet. You are also welcome to visit the auction offices in person to make bids. Bidders will need to pre-register for each auction by completing our online registration process.
Registration
When you register with us you are stating that you are eighteen [18] years of age or over. We do not allow persons who we know to be 17 years of age or younger to register with Barney Estates and Auctioneers. You agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate and complete and that you will ensure that this information is kept accurate and up to date at all times.
Content and Information
The description of the properties offered by us is for information purposes only. The information and descriptions contained herein are not intended to be complete descriptions of all the features. While we endeavour to ensure that the information and description are accurate and up to date, we cannot guarantee this. Any reliance on the information contained in the Site is at your own risk. We disclaim all warranties (expressed or implied) as to the accuracy or completeness of the information or materials contained on or linked to from the Site. You should (where relevant) consult the hard copy particulars relating to the property in which you are interested. These particulars are available from the branch address shown.
Legal Exclusions and Limitations
While we take every care to ensure that the standard of the Site remains high and to maintain the continuity of the Site, the Internet is not a stable medium and errors, omissions, interruptions of service and delays may occur at any time. As a result, we do not accept any ongoing obligation or responsibility to operate the Site (or any part of it) or to provide the services offered on the Site. In addition, we make no representations or warranties about the accuracy, completeness, and freedom from viruses, availability, reliability or suitability for any purpose of the information and related graphics published on the Site (including all texts, advertisements, links or other items) which may contain technical inaccuracies and typographical errors. The Sale of Goods Act(s) and all other legislation from time to time that imply terms into contracts is/are expressly excluded from application to the Site and the services supplied in connection with it to the fullest extent permitted by law.
We and all content providers and contributors to the Site disclaim and exclude to the fullest extent permitted by law all liability for any loss or damage whatsoever. whether arising in tort, contract, equity or otherwise and arising out of or in relation to or in connection with your access to or use of or inability to use the Site.
We are not providing any legal, accounting or any other professional advice or opinion on specific facts or matters and (other than in the case of fraudulent misrepresentations and representations expressly made in these terms and in our Privacy Policy) we exclude all representations and offer no warranties. Neither we nor any of our agents will be liable for damages arising out of or in connection with the use of the Site or the information contained in it. This is a comprehensive limitation of liability that applies to all damage of any kind including (without limitation), compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of opportunity, loss of or damage to property and third party claims save that nothing in the terms, conditions and provisions of the Site shall exclude or restrict liability for death or personal injury resulting from our negligence or that of our agents.
Privacy Policy
The Privacy Policy forms part of the terms, conditions and provisions of the Site and specifically forms part of these terms and conditions of use. Your use of or registration via the Site constitutes your acceptance of these terms and conditions and the Privacy Policy as amended from time to time.

Please be aware of the following conditions
- The attention of prospective buyers is drawn to the General and Special Conditions of Sale included within the auction pack.
- Prospective buyers shall be deemed to have inspected the relevant property and made all usual and necessary searches and enquiries, with all relevant authorities and other bodies.
- Prospective buyers should always check the addendum sheet and late addendum sheet to see if there are any alterations or amendments to the particulars of the Property or Properties that they are interested in bidding for.
- The seller has the right to sell before Auction, or withdraw the Lot, and neither the Auctioneer nor the Seller is responsible for any abortive costs, losses or damages of a prospective Buyer. Information as to pre-sale or withdrawal of a lot can be obtained from enquiry of the Auctioneers at any time prior to the Auction but valid up to the time of the enquiry.
- Prospective Buyers are advised to check particulars and measurements, areas and all other matters to which the properties are expressed to be subject to or have the benefit of and in respect of any contents fixtures or fittings expressed to be included to be included in the sale by making inspection of the property and all the necessary enquiries with Barney Estates Limited, the seller, the seller’s professional advisers, and all other appropriate authorities. All measurements and areas referred to in these particulars are approximate only.
- All Location Plans published in the particulars of sale are to enable prospective Buyers to locate the property only. The plans are photographically reproduced and therefore not to scale and are not intended to depict the interest to be sold but are for identification only. The boundary lines and numbers on the photographs are given only to enable prospective buyers to locate the property and are not intended to depict the interest to be sold. Buyers are advised to view the Special Conditions in respect of the precise interest to be conveyed.
- Any guide prices issued, or any estimates or values mentioned in negotiations or discussions, cannot be relied upon by prospective Buyers as representing professional valuations for any purpose in accordance with the requirements or guidance notes of relevant professional bodies, or other authorities. In all respects prospective Buyers are deemed to have relied upon their own knowledge or the advice of their own professional, or other, advisers.
- Inspection of investment properties courtesy of the Tenants. Inspection of the properties with vacant possession only by agreement with the Auctioneers. Interested parties must ring the office to discuss viewing arrangements or book keys before making their journey.
It is your responsibility to ensure you have completed all of your pre-auction checks which should include viewing the property, reading the legal pack (which can include costs in addition to the purchase price), checking the addendum for any changes to the catalogue, reading the important information, common auction conditions and remote bidding terms and conditions as well as arranging a survey and your finances (if applicable).
Every care has been taken with the preparation of Barney Estates and Auctioneers Particulars, but complete accuracy cannot be guaranteed. If there is any point, which is of particular importance to you, please obtain professional confirmation; alternatively, we will be pleased to check the information for you.

N.B. For each Lot, a contract documentation fee of £2,976 (inclusive of VAT) is payable to Barney Estates and Auctioneers by the buyer.
